Terms of Service
These terms govern the use of B-Connect (the "Service"), operated by B.HOSP, Lebanon. By using the Service, the business that signed up ("Client") and its users agree to them. A separate written agreement between B.HOSP and a Client prevails over these terms where they differ.
1. The Service
The Service lets a Client send and receive WhatsApp messages with its customers through the WhatsApp Business Platform: from a web portal, and from the Client's own systems through an API. The Client's WhatsApp Business Account and phone number belong to the Client; B.HOSP manages them on the Client's behalf.
2. The Client's responsibilities
- Comply with the WhatsApp Business Messaging Policy, the WhatsApp Business Terms of Service, Meta's Commerce Policy, and applicable law.
- Message only people who have agreed to receive messages from the Client (opt-in), keep a record of that agreement, and stop messaging anyone who asks it to stop (opt-out).
- Start conversations only with message templates approved by WhatsApp, and send other messages only within the 24-hour customer service window that the customer opens.
- Be responsible for the content of its messages and templates, and for the lawfulness of the personal data it sends, including health and other sensitive data.
- Keep its passwords and API secrets confidential, and tell us promptly about any unauthorised use.
3. Prohibited use
No spam, unsolicited bulk messaging, illegal, misleading, abusive or infringing content, no impersonation of another business, and no attempt to circumvent WhatsApp's or the Service's limits. B.HOSP may suspend a Client's access when this is breached or when Meta restricts the Client's account.
4. Subscription and fees
The Service is billed as a monthly subscription, paid in advance at the price agreed with the Client; all messages are included. When a subscription is not renewed, sending is paused after a grace period (receiving messages continues) until it is renewed. WhatsApp's own fees are billed by Meta directly to the Client's WhatsApp Business Account. Prices may change with notice to the Client.
5. Availability
The Service depends on WhatsApp, Meta and other providers. B.HOSP does its best to keep it available but does not guarantee uninterrupted service or delivery of every message, and is not liable for delays or failures caused by those providers, by recipients, or by events beyond its control.
6. Data protection
Personal data is processed as described in our Privacy Policy. For the Client's messages, B.HOSP acts as the Client's processor.
7. Liability
To the extent permitted by law, B.HOSP's total liability is limited to the amounts the Client paid for the Service in the three months before the event giving rise to the claim. B.HOSP is not liable for indirect or consequential losses.
8. Ending the Service
Either party may end the Service with notice. The Client can ask us to transfer its WhatsApp number to another provider and to delete its data, as described in the data deletion instructions.
9. Law
These terms are governed by the laws of Lebanon.
